Companies, local authorities&#8230; The framework defined by the GDPR allows each structure to develop its activity on the basis of <strong>users&#8217; trus<\/strong>t and the <strong>consenting sharing of their personal data.<\/strong><\/p>\n\n\n\n<h3 class=\"wp-block-heading\" id=\"h-what-is-personal-data\"><strong>What is personal data?<\/strong><\/h3>\n\n\n\n<blockquote class=\"wp-block-quote is-style-author-quote is-layout-flow wp-block-quote-is-layout-flow\">\n<p><strong><em>&#8220;Any information relating to a physical person who can be identified directly or indirectly.&#8221;<\/em><\/strong><\/p>\n<cite><a href=\"https:\/\/www.cnil.fr\/fr\/cnil-direct\/question\/une-donnee-caractere-personnel-cest-quoi\">CNIL<\/a> (the National Commission for Information Technology and Civil Liberties,<br>authority on the subject)<br>  <\/cite><\/blockquote>\n\n\n\n<p>In other words, personal data is any<strong> information that can be used to identify a person<\/strong>, either directly or by cross-referencing with other data.<\/p>\n\n\n\n<div class=\"wp-block-columns is-layout-flex wp-container-core-columns-is-layout-9d6595d7 wp-block-columns-is-layout-flex\">\n<div class=\"wp-block-column is-layout-flow wp-block-column-is-layout-flow\" style=\"flex-basis:66.66%\">\n<p>For example, <strong>the first and last name<\/strong> of a user are direct identification data: a person can be found and recognized using these two pieces of information.<\/p>\n\n\n\n<p>Instead, some data needs to be crossed or deepened<strong> to find the identity of the person<\/strong> to whom they correspond, such as a <strong>postal address, an IP or e-mail address, a telephone number, an identifier<\/strong> (of connection \/ serial number&#8230;).\u00a0<\/p>\n<\/div>\n\n\n\n<div class=\"wp-block-column is-layout-flow wp-block-column-is-layout-flow\" style=\"flex-basis:33.33%\">\n<figure class=\"wp-block-image size-large is-resized\"><img decoding=\"async\" src=\"https:\/\/www.wsinteractive.com\/wp-content\/uploads\/2023\/02\/article_image_3-1024x986.png\" alt=\"\" class=\"wp-image-5383\" width=\"246\" height=\"236\" srcset=\"https:\/\/www.wsinteractive.com\/wp-content\/uploads\/2023\/02\/article_image_3-1024x986.png 1024w, https:\/\/www.wsinteractive.com\/wp-content\/uploads\/2023\/02\/article_image_3-300x289.png 300w, https:\/\/www.wsinteractive.com\/wp-content\/uploads\/2023\/02\/article_image_3-768x740.png 768w, https:\/\/www.wsinteractive.com\/wp-content\/uploads\/2023\/02\/article_image_3.png 1081w\" sizes=\"(max-width: 246px) 100vw, 246px\" \/><\/figure>\n<\/div>\n<\/div>\n\n\n\n<h3 class=\"wp-block-heading\" id=\"h-how-is-personal-data-collected-from-users-of-a-site\"><strong>How is personal data collected from users of a site?<\/strong><\/h3>\n\n\n\n<p>Polls and surveys, customer acquisition or satisfaction forms, site traffic monitoring instruments, tracking and other marketing tools&#8230; There are many ways to collect data, and they tend to diversify with each technological evolution!<\/p>\n\n\n\n<p>Some examples to see more clearly, in the concrete of a <strong>website<\/strong> :<\/p>\n\n\n\n<ul class=\"wp-block-list\">\n<li><strong><strong>Direct means: <\/strong><\/strong>contact form, account creation, registration to a service (Newsletter, Email alerts, E-commerce&#8230;)<\/li>\n<\/ul>\n\n\n\n<ul class=\"wp-block-list\">\n<li><strong>Indirect means<\/strong>: <strong><strong><a href=\"https:\/\/www.cnil.fr\/fr\/definition\/cookie\">Cookies<\/a><\/strong><\/strong> of Google Analytics, Google Tag Manager, Google Maps, Facebook Pixel, Recaptcha, etc.\u00a0<\/li>\n<\/ul>\n\n\n\n<div style=\"height:6px\" aria-hidden=\"true\" class=\"wp-block-spacer\"><\/div>\n\n\n\n<h2 class=\"wp-block-heading\" id=\"h-reflexes-and-best-practices-for-gdpr-compliance\">Reflexes and best practices for GDPR compliance<\/h2>\n\n\n\n<p>You want to make your website GDPR compliant, but don&#8217;t know where to start? We give you some good reflexes to take in your compliance process.<\/p>\n\n\n\n<p><strong><strong>The basic principles? <mark style=\"background-color:#9b51e0\" class=\"has-inline-color has-white-color\">Transparency<\/mark> and <mark style=\"background-color:#9b51e0\" class=\"has-inline-color has-white-color\">respect<\/mark>, for maximum trust!<\/strong><\/strong><\/p>\n\n\n\n<p><strong><strong>The 3 golden rules of GDPR to remember:<\/strong><\/strong><\/p>\n\n\n\n<ul class=\"wp-block-list\">\n<li><strong>Inform <\/strong>users<\/li>\n\n\n\n<li>Ensure their<strong> consent&nbsp;<\/strong><\/li>\n\n\n\n<li>Give them<strong> control over their data <\/strong>(rectification or anonymization, for example)<\/li>\n<\/ul>\n\n\n\n<div style=\"height:16px\" aria-hidden=\"true\" class=\"wp-block-spacer\"><\/div>\n\n\n\n<h3 class=\"wp-block-heading\" id=\"h-identify-and-define-the-personal-data-collections-on-your-site\"><strong>Identify and define the personal data collections on your site<\/strong><\/h3>\n\n\n\n<div class=\"wp-block-columns is-layout-flex wp-container-core-columns-is-layout-9d6595d7 wp-block-columns-is-layout-flex\">\n<div class=\"wp-block-column is-layout-flow wp-block-column-is-layout-flow\" style=\"flex-basis:66.66%\">\n<p>First step:<strong><strong> the inventory<\/strong><\/strong>!<\/p>\n\n\n\n<p>The objective is to<strong> know the data collected<\/strong> in the course of your activities.<\/p>\n\n\n\n<p>On your website, <strong>identify the elements that collect personal data <\/strong>from your users. For each data collected, try to answer these 5 key questions:<\/p>\n\n\n\n<p>Pour chaque donn\u00e9e r\u00e9colt\u00e9e, essayez de r\u00e9pondre \u00e0 ces 5 questions cl\u00e9s&nbsp; :<\/p>\n\n\n\n<ul class=\"wp-block-list\">\n<li><strong>What ? <\/strong>What kind of data is it? Public data? Personal, even sensitive?<\/li>\n\n\n\n<li><strong>Who ?<\/strong> &#8211; Who manages the collection and processing of the data?&nbsp;<\/li>\n\n\n\n<li><strong>Where ?<\/strong> &#8211; Where is this data processed and stored? In France (at best), in Europe&#8230; or outside the EU?<\/li>\n\n\n\n<li><strong>How much time ?<\/strong> How long will you need this personal data?<\/li>\n<\/ul>\n\n\n\n<p>And last but not least&#8230;\u00a0<\/p>\n\n\n\n<ul class=\"wp-block-list\">\n<li><strong><em>Why ?<\/em><\/strong><em> <\/em>Why do you need this data? Is it really important to your strategy?<\/li>\n<\/ul>\n\n\n\n<p>This last question will probably allow you to sort through your data, keeping only the personal data that is most important to your business. The key idea: the less, the better! Because the best way to comply with the GDPR&#8230; is still to not collect data (or at least to limit and protect it) \ud83d\ude09\u00a0<\/p>\n\n\n\n<h3 class=\"wp-block-heading\" id=\"h-inform-your-users-about-the-personal-data-collected-for-your-business\"><strong>Inform your users about the personal data collected for your business<\/strong><\/h3>\n\n\n\n<p>Have you <strong>identified<\/strong> and <strong>qualified the data collected<\/strong> in the course of your activities? Great! Now you need to be able to <strong>inform your users about the use of this data.<\/strong><\/p>\n\n\n\n<p><strong>3 places to remember<\/strong> to inform your users about their data collection:<\/p>\n\n\n\n<ul class=\"wp-block-list\">\n<li><strong>The Privacy Policy &amp; Data Usage page <\/strong>&#8211; It will allow you to track all the measures taken to respect and protect your users&#8217; rights (data protection &amp; anonymization, opposition channels&#8230;). It is also a good place to remind them of <strong>their rights<\/strong> (access, rectification, opposition and deletion of their data).<\/li>\n<\/ul>\n\n\n\n<ul class=\"wp-block-list\">\n<li><strong>The Cookies banner <\/strong>&#8211; to collect users&#8217; consent, allowing them<strong> to accept, refuse or modify their choice<\/strong> easily, when visiting a web page. <em>With a little creativity and customization, this required banner can even become a little extra design for your site!<\/em><\/li>\n<\/ul>\n\n\n\n<ul class=\"wp-block-list\">\n<li><strong>The page where a form is located <\/strong>collecting personal data (usually under the form itself).<\/li>\n<\/ul>\n\n\n\n<div style=\"height:29px\" aria-hidden=\"true\" class=\"wp-block-spacer\"><\/div>\n\n\n\n<h3 class=\"wp-block-heading\" id=\"h-gdpr-consent-giving-your-users-the-choice-to-opt-out-of-the-collection-of-their-personal-data\"><strong>GDPR &amp; Consent: giving your users the choice to opt out of the collection of their personal data<\/strong><\/h3>\n\n\n\n<p>Along with transparency, <mark style=\"background-color:#9b51e0\" class=\"has-inline-color has-white-color\"><strong>consent<\/strong><\/mark><strong> is <em>the <\/em>fundamental pillar of the GDPR<\/strong>. All this while keeping the data necessary for reporting on internal training in the public service!
