The <strong>right to information<\/strong> for your users is a fundamental principle of the <strong>General Data Protection Regulation<\/strong>.<\/p>\n\n\n\n<p>Your users have the <strong>right to know<\/strong>:<\/p>\n\n\n\n<ul class=\"wp-block-list\">\n<li>What personal data is collected about them, and how;<\/li>\n<\/ul>\n\n\n\n<ul class=\"wp-block-list\">\n<li>Whether the collection of this data is mandatory or optional;<\/li>\n<\/ul>\n\n\n\n<ul class=\"wp-block-list\">\n<li>For what purpose the data is collected and used (<strong>the purpose(s)<\/strong>);<\/li>\n<\/ul>\n\n\n\n<ul class=\"wp-block-list\">\n<li>Who manages the collection, storage &amp; use of this data (<strong>the controller<\/strong>)<\/li>\n<\/ul>\n\n\n\n<ul class=\"wp-block-list\">\n<li>How long their data can be stored and used;<\/li>\n<\/ul>\n\n\n\n<ul class=\"wp-block-list\">\n<li>If their data is <strong>transferred<\/strong> \/ processed or stored abroad (outside the EU);<\/li>\n<\/ul>\n\n\n\n<div class=\"wp-block-columns is-layout-flex wp-container-core-columns-is-layout-9d6595d7 wp-block-columns-is-layout-flex\">\n<div class=\"wp-block-column is-layout-flow wp-block-column-is-layout-flow\" style=\"flex-basis:66.66%\">\n<p><strong>In short:<\/strong> you need to be clear and transparent <strong>about the Why &amp; How of each data collection<\/strong>.<\/p>\n\n\n\n<p>A good practice to apply to make sure everyone understands? Inform your users in a clear and concise way. Explain to them as simply as possible the purpose and modalities of each data collection!<\/p>\n<\/div>\n\n\n\n<div class=\"wp-block-column is-layout-flow wp-block-column-is-layout-flow\" style=\"flex-basis:33.33%\">\n<figure class=\"wp-block-image size-medium\"><img decoding=\"async\" width=\"300\" height=\"289\" src=\"https:\/\/www.wsinteractive.com\/wp-content\/uploads\/2023\/03\/article_image_2-1-300x289.png\" alt=\"\" class=\"wp-image-6120\" srcset=\"https:\/\/www.wsinteractive.com\/wp-content\/uploads\/2023\/03\/article_image_2-1-300x289.png 300w, https:\/\/www.wsinteractive.com\/wp-content\/uploads\/2023\/03\/article_image_2-1-1024x986.png 1024w, https:\/\/www.wsinteractive.com\/wp-content\/uploads\/2023\/03\/article_image_2-1-768x740.png 768w, https:\/\/www.wsinteractive.com\/wp-content\/uploads\/2023\/03\/article_image_2-1.png 1081w\" sizes=\"(max-width: 300px) 100vw, 300px\" \/><\/figure>\n<\/div>\n<\/div>\n\n\n\n<p>Without forgetting, of course, <strong>to remind them of the various rights<\/strong> they can assert at any time on their data!<\/p>\n\n\n\n<p><strong>Right <\/strong>of<strong> access, portability, rectification, opposition, deletion, complaint \u2026 <\/strong>We will decipher them together to help you see more clearly \ud83d\ude09<\/p>\n\n\n\n<div style=\"height:14px\" aria-hidden=\"true\" class=\"wp-block-spacer\"><\/div>\n\n\n\n<h3 class=\"wp-block-heading\" id=\"h-access-amp-management-rights-to-their-data\"><mark style=\"background-color:#ffffff;color:#8865fa\" class=\"has-inline-color\">Access &amp; management rights to their data<\/mark><\/h3>\n\n\n\n<p>The data of your users concerns them directly. It is therefore logical and essential to allow them <strong>to consult<\/strong> and <strong>retrieve<\/strong> it if they wish! This is the very <strong>principle of access<\/strong> and <strong>portability rights<\/strong>.<\/p>\n\n\n\n<p><strong>Right of access and portability: what is the difference?<\/strong><\/p>\n\n\n\n<p><mark style=\"background-color:rgba(0, 0, 0, 0);color:#8865fa\" class=\"has-inline-color\"><strong>\u2713<\/strong><\/mark><strong><mark style=\"background-color:rgba(0, 0, 0, 0);color:#8865fa\" class=\"has-inline-color\">Right of access:<\/mark><\/strong>each user has the right to ask you for access to the personal data collected about him\/her. You must then provide him\/her with a <strong>copy of this data within a short period of time, while respecting his\/her right to information <\/strong>(specify in your e-mail the origin of the data, the purposes of the processing, the period of retention, etc.).<\/p>\n\n\n\n<p><mark style=\"background-color:rgba(0, 0, 0, 0);color:#8865fa\" class=\"has-inline-color\"><strong>\u2713<\/strong><\/mark><strong><mark style=\"background-color:rgba(0, 0, 0, 0);color:#8865fa\" class=\"has-inline-color\">Right to portability:<\/mark><\/strong> with this right, your users can retrieve and manage all or part of their data, either for personal use or for transfer to third-party providers. To respect <strong>this right, you must transfer your users&#8217; data in a structured, commonly used and readable digital format<\/strong> (e.g. Excel spreadsheet).<\/p>\n\n\n\n<p>Beyond the right of access and portability, your users have all the rights <strong>to manage the data<\/strong> you collect about them.<\/p>\n\n\n\n<p>Because the main objective of the RGPD is to allow them <strong>to keep control and master their data!<\/strong><\/p>\n\n\n\n<p>It goes through the reminder &amp; respect of their :<\/p>\n\n\n\n<p><strong><mark style=\"background-color:rgba(0, 0, 0, 0);color:#8865fa\" class=\"has-inline-color\">\u2713 Right of rectification:<\/mark><\/strong> to correct inaccurate data (example: age, incorrectly entered last name\u2026) or complete data (incomplete postal address\u2026) in connection with the purpose of processing each data collected.<\/p>\n\n\n\n<p><strong><mark style=\"background-color:rgba(0, 0, 0, 0);color:#8865fa\" class=\"has-inline-color\">\u2713 Right to limit processing:<\/mark><\/strong> to temporarily freeze the use of certain data. These data are then kept but can no longer be used, the time to take into account a request for rectification or opposition, for example.<\/p>\n\n\n\n<p><strong><mark style=\"background-color:rgba(0, 0, 0, 0);color:#8865fa\" class=\"has-inline-color\">\u2713 Right to object:<\/mark><\/strong> to object at any time to the use of personal data collected.<\/p>\n\n\n\n<p>There are two cases to be aware of for the <strong>right to object<\/strong>:<\/p>\n\n\n\n<p><strong>Commercial prospecting:<\/strong> In the case of collections made for <strong>commercial prospecting<\/strong>, this right applies automatically, unconditionally: no particular justification is required. You must immediately <strong>stop the use of the data mentioned by the requesting user<\/strong>.<\/p>\n\n\n\n<p><strong>Except for commercial prospecting:<\/strong> you keep a possible right of refusal of this request, which will however have to be <strong>justified to your user<\/strong>. You can invoke <strong>legitimate or compelling reasons<\/strong>, the <strong>consent of your user<\/strong> as a legal basis for the use of his data, or a <strong>contract<\/strong> binding you to the user in this specific context. The user may then <strong>withdraw his consent<\/strong> or <strong>breach your contract to re-examine his right to object.<\/strong><\/p>\n\n\n\n<div style=\"height:13px\" aria-hidden=\"true\" class=\"wp-block-spacer\"><\/div>\n\n\n\n<h3 class=\"wp-block-heading\" id=\"h-the-right-to-erase-personal-data\"><mark style=\"background-color:#ffffff;color:#8865fa\" class=\"has-inline-color\">The right to erase personal data<\/mark><\/h3>\n\n\n\n<p>And after <strong>opposition<\/strong>\u2026 it&#8217;s the<strong><mark style=\"background-color:rgba(0, 0, 0, 0);color:#8865fa\" class=\"has-inline-color\">right to deletion<\/mark><\/strong>!<\/p>\n\n\n\n<p>You should know that your users have every <strong>right to ask you to delete the personal data you have collected about them!<\/strong><\/p>\n\n\n\n<p>Your user should <strong>specify in as much detail as possible which personal data should be deleted<\/strong>.<\/p>\n\n\n\n<p>For the CNIL : <em>&#8220;The exercise of this right does not entail the simple and definitive deletion of all data concerning <strong>[<\/strong>him\/her].&#8221;<\/em><\/p>\n\n\n\n<p>Like the right <strong>to object<\/strong>, this request does not need any particular justification to be valid if the data has been collected for <strong>commercial prospecting<\/strong> purposes.<\/p>\n\n\n\n<p>Except for commercial prospecting, a person can <strong>exercise his right and request the deletion of his data<\/strong> when :<\/p>\n\n\n\n<ul class=\"wp-block-list\">\n<li>It considers that the data is no longer necessary to pursue your purposes (reason for collecting its data has been fulfilled or is no longer valid, the &#8220;time limit for use&#8221; of its data has expired),<\/li>\n<\/ul>\n\n\n\n<ul class=\"wp-block-list\">\n<li>He\/she <strong>withdraws his\/her consent for the use<\/strong> of his\/her data,<\/li>\n<\/ul>\n\n\n\n<ul class=\"wp-block-list\">\n<li>The data is processed unlawfully or must be deleted to comply with a new legal obligation.<\/li>\n<\/ul>\n\n\n\n<p>If there is no legitimate or really critical reason to question this request, you just have <strong>to respect<\/strong> your user&#8217;s wish!<\/p>\n\n\n\n<div style=\"height:12px\" aria-hidden=\"true\" class=\"wp-block-spacer\"><\/div>\n\n\n\n<div style=\"height:12px\" aria-hidden=\"true\" class=\"wp-block-spacer\"><\/div>\n\n\n\n<h3 class=\"wp-block-heading\" id=\"h-gdpr-rights-outside-the-european-union-eu-what-you-need-to-know\"><mark style=\"background-color:#ffffff;color:#8865fa\" class=\"has-inline-color\">GDPR rights outside the European Union (EU): what you need to know<\/mark><\/h3>\n\n\n\n<div style=\"height:6px\" aria-hidden=\"true\" class=\"wp-block-spacer\"><\/div>\n\n\n\n<div class=\"wp-block-columns is-layout-flex wp-container-core-columns-is-layout-9d6595d7 wp-block-columns-is-layout-flex\">\n<div class=\"wp-block-column is-layout-flow wp-block-column-is-layout-flow\" style=\"flex-basis:66.66%\">\n<p>These rights apply to <strong>all organizations based in the EU<\/strong>.<\/p>\n\n\n\n<p>But what about data processing outside of Europe?<\/p>\n\n\n\n<p><strong><em>As a reminder:<\/em><\/strong> The <strong>GDPR <\/strong>applies to <strong>all organizations processing personal data in the European Union<\/strong> (EU), but also to <strong>organizations offering goods\/services to people residing in the European Union!<\/strong><\/p>\n<\/div>\n\n\n\n<div class=\"wp-block-column is-layout-flow wp-block-column-is-layout-flow\" style=\"flex-basis:33.33%\">\n<figure class=\"wp-block-image size-medium is-resized\"><img decoding=\"async\" width=\"300\" height=\"289\" src=\"https:\/\/www.wsinteractive.com\/wp-content\/uploads\/2023\/03\/article_image_3-1-300x289.png\" alt=\"\" class=\"wp-image-6122\" style=\"width:241px;height:232px\" srcset=\"https:\/\/www.wsinteractive.com\/wp-content\/uploads\/2023\/03\/article_image_3-1-300x289.png 300w, https:\/\/www.wsinteractive.com\/wp-content\/uploads\/2023\/03\/article_image_3-1-1024x986.png 1024w, https:\/\/www.wsinteractive.com\/wp-content\/uploads\/2023\/03\/article_image_3-1-768x740.png 768w, https:\/\/www.wsinteractive.com\/wp-content\/uploads\/2023\/03\/article_image_3-1.png 1081w\" sizes=\"(max-width: 300px) 100vw, 300px\" \/><\/figure>\n<\/div>\n<\/div>\n\n\n\n<p><strong>The RGPD therefore applies in 2 cases:<\/strong><\/p>\n\n\n\n<ul class=\"wp-block-list\">\n<li>If your organization is <strong>based in a country belonging to the European Union<\/strong>.<\/li>\n<\/ul>\n\n\n\n<ul class=\"wp-block-list\">\n<li>If your organization directly <strong>targets users in the European Union<\/strong>.<\/li>\n<\/ul>\n\n\n\n<p>Technically, Google, Facebook and other GAFAs are therefore obliged to respect the RGPD, just like you!<\/p>\n\n\n\n<p>Whether you are a company based outside the EU targeting European users or conversely, a European organization targeting users outside Europe, these rights must be taken into account in your activities.<\/p>\n\n\n\n<p><strong>And outside the jurisdiction of the European Union?<\/strong><\/p>\n\n\n\n<p>Users outside the EU see their data protected differently.<\/p>\n\n\n\n<p>For example, in the United States, in some cases, you cannot store European personal data.<\/p>\n\n\n\n<p>For the <a href=\"https:\/\/www.cnil.fr\/\" target=\"_blank\" rel=\"noreferrer noopener\">CNIL<\/a>, <strong>&#8220;The United States has national data privacy legislation and a data protection authority recognized by the Global Privacy Assembly.&#8221;<\/strong><em>\u00a0<\/em><\/p>\n\n\n\n<p><strong>In the case of data transfer outside the EU:<\/strong><\/p>\n\n\n\n<p>You can <strong><a href=\"https:\/\/www.cnil.fr\/fr\/transferts-de-donnees-hors-ue-le-cadre-general-prevu-par-le-rgpd\" target=\"_blank\" rel=\"noreferrer noopener\">transfer your users&#8217; data outside the European Union<\/a><\/strong> provided you <strong>ensure a sufficient and appropriate level of data protection<\/strong>, via regulated tools <em>(contractual clauses, code of conduct, certification or administrative arrangement).<\/em><\/p>\n\n\n\n<p><strong>In short: <\/strong>European personal data transferred to the U.S. or outside the European Union must be carefully managed with appropriate transfer tools and procedures.<\/p>\n\n\n\n<p>But don&#8217;t panic! The answer is yes, and that is <strong>pseudonymization and anonymization<\/strong>!<\/p>\n\n\n\n<p>The difference? One protects the data more than the other!<\/p>\n\n\n\n<p><strong>Protection Level 1: Pseudonymization<\/strong> &#8211; Pseudonymizing your users&#8217; data consists of <strong>replacing directly identifying data <\/strong>(name, first name, etc.) with indirect identifiers (serial number, nickname, etc.). With the right reading code, it is however possible to find the identity of the person studied. This is the first level of protection!<\/p>\n\n\n\n<p><strong>Level of protection 2: <a href=\"https:\/\/www.cnil.fr\/fr\/lanonymisation-de-donnees-personnelles\" target=\"_blank\" rel=\"noreferrer noopener\">Anonymization<\/a><\/strong>: &#8220;Anonymizing the data consists in <strong><em>&#8220;making impossible, in practice, any identification of the person by any means and in an irreversible way&#8221;<\/em><\/strong>. This is the highest level of protection and security! Properly done, it can allow you to c<strong>ontinue processing collected personal data<\/strong>, without threatening the privacy of the persons concerned!<\/p>\n\n\n\n<p>By preventing the data from being traced back to the target user, this process makes it possible <strong>to keep statistical data without jeopardizing the privacy of your users, and even beyond their retention period<\/strong>!<\/p>\n\n\n\n<p>Convenient, right?
